Agreement

These terms are an agreement between Hubback Management Company, Inc., doing business as Hubback Property Management (“we”, “us”), and you (“you”). By using www.hubbackpropertymanagement.com, requesting a consultation, booking a stay, or using our services, you agree to these terms. If you do not agree, please do not use the website or services.

Our services

Hubback Property Management cares for a small collection of vacation homes in California, including homes we own and homes we manage on behalf of their owners. Our website lets you view the homes, check availability and book a stay, ask a question, and request a property management consultation. We may improve or change our services and website over time.

Bookings, rates, and payment

• Stays are booked through our booking provider, Lodgify. Rates, taxes, fees, deposits, house rules, and cancellation terms are shown before you pay and are set out in your reservation confirmation, which controls if it conflicts with these terms.
• Rates and availability shown on the website may change until a reservation is confirmed. Where a home is also listed on a platform such as Airbnb, that platform’s terms apply to bookings made there.
• Stays are subject to availability. A reservation is confirmed only when you receive our written confirmation, and we will contact you if a change is needed.
• Payment terms, including any deposit or damage protection, are set out in your reservation confirmation.

Consultations for owners

• Consultations are free and carry no obligation.
• Consultations are subject to availability. We will confirm your visit and contact you if a change is needed.
• A consultation or a quoted fee is not a management agreement. If we work together, a written management agreement sets out the services, the fee, and the term, and it controls if it conflicts with these terms.

Your responsibilities

• Provide accurate contact details and keep them current, so we can reply to you and confirm your stay or visit.
• Use the website lawfully. Do not attempt to disrupt it, access it without authorization, or submit false information.
• Only submit a phone number or email address that belongs to you or that you are authorized to provide.
• Treat the homes with care during a stay, and follow the house rules in your reservation confirmation.

Text messaging (SMS)

If you give us your mobile number and affirmatively opt in, for example by checking the consent box on one of our forms, Hubback Property Management may send you text messages. Depending on the consent you give, these may include replies to your inquiry, booking and appointment confirmations, reminders, and updates about your stay or your home.

• Message frequency varies. Message and data rates may apply.
• Reply STOP to opt out at any time. Reply HELP for help, or contact us at 1 831-777-6114 or sarah@hubbackpropertymanagement.com.
• Consent to receive text messages is not a condition of booking a stay or purchasing any goods or services.
• Carriers are not liable for delayed or undelivered messages.
• You must be 18 years of age or older to use this service.
• We do not share mobile information or text message consent with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for details.

Content and ownership

The content on this website, including text, photography, logos, and design, is owned by or licensed to Hubback Management Company, Inc.. You may not copy, reproduce, or use it without our prior written permission. You keep ownership of the information you submit to us, and you grant us the rights needed to use it to respond to you and provide our services, as described in our Privacy Policy.

Services from third parties

The website relies on providers such as hosting, booking, messaging, mapping, and form platforms. Their availability is outside our full control, and their terms may apply to your use of features they power. Please confirm details such as rates, availability, and dates with our team.

Disclaimers and limitation of liability

The website is provided as is and as available. To the fullest extent allowed by law, we disclaim implied warranties for the website and are not liable for indirect, incidental, or consequential damages arising from your use of the website, including lost profits or lost business opportunities. This section does not limit any commitment in your reservation confirmation or written management agreement, or any liability that cannot be limited under applicable law.

Indemnification

You will defend and hold us harmless from claims arising out of your misuse of the website, information you submit that you did not have the right to provide, or your breach of these terms.

Suspension of access

We may suspend or restrict access to the website for unlawful use or a breach of these terms. Sections on ownership, disclaimers, liability, and indemnification survive any suspension.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in Santa Cruz County, California, and both sides consent to that venue.

Changes to these terms

We may update these terms from time to time. We will post the new version here and update the effective date above. Continued use of the website or services after changes take effect means you accept the updated terms.
